Le Testament de Marguerite Selam

(Her Last Will and Testament)

La Nouvelle Orléans, le 7 juin 1818

Thanks to the research patiently done by Scott Plauché in the Notarial Archives of New Orleans in the summer 2000, we are able to publish a fairly complete transcription (and a somewhat litteral translation) of Marguerite Selam's last will and testament.

You may read the original text by clicking on each of the four pages that it contains. Any improvement of the transcription will be appreciated.

You will see that the following text refers to an inventory of Etienne Henry and Marguerite's belongings. Scott also managed to discover this moving document.

Fut présente Dame Marguerite Selam, demeurant en cette ville, veuve de feu Sieur Etienne Plauché, décédé en cette ville, que les notaire et témoins soussignés ont trouvée, dans une maison appartenant au Sieur Jean Jacques Chessé et où demeure ce dernier [... ...] des rues St Philipe, et {de} la Levée, dans une chambre haute de la quelle maison, les dits notaire et témoins ont trouvé la dite Dame comparante couchée dans un lit, malade du corps mais saine d'esprit, mémoire et entendant [..] ainsi qu'il est apparu aux dits notaire et témoins soussignés; la quelle dite Dame comparante a requis le dit notaire de recevoir son testament qu'elle lui a dicté ainsi qu'il suit.	Was present Dame Marguerite Selam, residing in this city, widow of the late Sir Etienne Plauché, deceased in this city, that the undersigned notary and witnesses found in a house belonging to Sir Jean Jacques Chessé and where the latter resides [... ...] the streets St Philipe, and the levee, in an upper room of said house, said notary and witnesses have found said comparant Dame, lying in bed, ill in her body but not in her mind, memory and understanding [...] as it appeared to said undersigned notary and witnesses, which said comparant Dame requested said notary to receive her [last will and] testament which she dictated to him as follows.
"Moi Marguerite Selam, âgée d'environ soixante huit ans, native de cette ville et y domiciliée [...], fille légitime de feu Sieur Jacques Selam et de feue Dame Marie Magdelaine Goleur, mes père et mère décédés;	"I Marguerite Selam, aged about sixty eight years, native of this city and residing here [...], legitimate daughter of the late Sir Jacques Selam and of the late Dame Marie Magdelaine Goleur, my deceased father and mother;

Les dettes contre la succession sont connues de mes enfants qui les payeront et acquitteront ainsi que celles en faveur qui seront recouvrées par mon exécuteur testamentaire.	As my belongings as well as those of the succession of my said late husband are together and at [...] of all my children who are all major, it is useless to enumerate them in detail and [...] that the executor of my last will, hereafter named will also learn of said belongings. The debts against the succession are known to my children who will pay and acquit them, as well as those in favour which will be collected by the executor of my will.

C'est ainsi que ce testament a été dicté par la dite Dame testatrice au dit notaire qui l'a écrit de sa propre main tel qu'il lui a été dicté [.. ...] et sans divertir à d'autres actes et en présence des témoins soussignés, et le dit notaire ayant lu ce testament en la même présence à la dite Dame testatrice, cet{te} dernière a déclaré le bien entendre et comprendre et y persévérer. Personal notes from the transcriber: This testament was dictated the day before Marguerite Selam died. She did not die in her own house but in that of her daughter and Chessé son-in-law. In this will, she favors her daughters, two of whom had married in the Chessé family. The donation that she makes in this document would normally be considered illegal in French law: donations made close to someone's death must be considered as part of the inheritance.
